INQUIRY CANCELLATION 

Sometimes, due to unavoidable circumstances certain inquiries having been validly placed may not be processed or are capable of being attended to. AASR Collaborative reserves the right to refuse or cancel any order inquiry for any reason. Some situations that may result in your order  inquiry being cancelled shall include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or any defect regarding the quality of the product. We may also require additional verifications or information before accepting any order.

We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your payment has been charged, the said amount will be reversed into your Account/ as the case may be to the source of the payment within a period of 30 working days. Any type of voucher used in these orders shall be returned and made available to the user in case of cancellation by AASR Collaborative.

AASR Collaborative attempts to be as accurate as possible. However, AASR Collaborative does not warrant the content to be accurate, complete, reliable, current, or error-free. If a product offered by AASR Collaborative is not as described, your sole remedy is to contact AASR Collaborative within 48 hours of receipt, and AASR Collaborative reserves the right to provide a solution as per its discretion.

SEVERABILITY 

If any provision of the Terms of Use is determined to be invalid in whole or in part, such invalidity or unenforceability shall attach only to such provision and the remaining part of such provision and all other provisions of the Terms of Use shall continue to be in full force and effect. 

NO WAIVER 

If we fail to enforce at any time or for any period any one or more of the terms or conditions of the Agreement shall not be a waiver by the AASR Collaborative of them or of the right any time subsequent to enforce all Terms and Conditions of this agreement. 

FORCE MAJEURE 

AASR Collaborative will not be liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is 

  1. beyond the reasonable control of us,
  2. materially affects the performance of any of its obligations under this agreement, and
  3. could not reasonably have been foreseen or provided against, but will not be excused for failure or delay resulting from only general economic conditions or other general market effects.
  4. due to Covid-19 restrictions or lockdowns imposed in a particular area or due to the spread of another pandemic/epidemic 

DISPUTE RESOLUTION AND GOVERNING LAW 

These Terms and Conditions or the documents of third-party payment channels shall be governed and construed in accordance with the laws of India. This document is an electronic record in terms of the Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Any disputes, difference or claim arising between the parties out of or in relation to or in connection with the Terms of Service, or the breach, termination, effect, validity, interpretation or application of this agreement as to their rights, duties or liabilities hereunder, shall be settled by the parties by mutual negotiations and agreement.

If for any reason, such dispute cannot be resolved amicably by the parties, the same shall be referred to and settled by way of arbitration proceedings, through reference to a sole arbitrator. The Act applicable to any or all of the proceedings arising out of this Agreement shall be the Arbitration and Conciliation Act, 1996 as amended from time to time.

The effectiveness, construction and enforcement of this Agreement shall be governed by Indian laws. The Parties hereby submit to the exclusive jurisdiction of the courts of New Delhi in respect of any dispute arising in connection herewith

Implementation or breach of any provision of the Terms & Conditions and/or Privacy Policy including but not limited to the rules and policies contained herein, the dispute shall be subject to the exclusive jurisdiction to the Courts of New Delhi. Your obligations to pay the Payment Fees dues shall not be suspended during the pendency of such proceedings.  

GRIEVANCES 

Any grievances can be addressed to the ‘Customer Care’ by way of email to  info@ aasrcollaborative.com. We shall thereafter consider the same and provide a response within one month of the date of such complaint/ grievance.
